PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE DOING BUSINESS WITH SWS RIFLES. All buyers agree that they are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not move forward with SWS Rifles.
By giving SWS Rifles LLC payment or deposit, the customer agrees to all terms and conditions.
Copyright
The entire content included in this site, including but not limited to text, graphics or code is copyrighted as a collective work under the United States and other copyright laws, and is the property of SWS Rifles LLC. The collective work includes works that are licensed to SWS Rifles LLC. Copyright 2022, SWS Rifles LLC ALL RIGHTS RESERVED. Permission is granted to electronically copy and print hard copy portions of this site for the sole purpose of placing an order with SWS Rifles LLC or purchasing SWS Rifles LLC products. You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from the different areas of the site solely for your own non-commercial use, or to place an order with SWS Rifles LLC or to purchase SWS Rifles LLC products. Any other use, including but not limited to the reproduction, distribution, display or transmission of the content of this site is strictly prohibited, unless authorized by SWS Rifles LLC. Warranty Disclaimer
SWS Rifles LLC manufactured or branded products come with a limited lifetime warranty granted to the original owner of the product. This warranty is non-transferable. SWS Rifles LLC products are warranted to be free of manufacture and workmanship defects. Under this warranty SWS Rifles LLC upon inspection will repair or replace a product due to any defects found in material or workmanship.
SWS Rifles LLC warranty will not cover any of the following: Unauthorized alterations to a firearm or upper. Changing of a product any way from the factory condition. Careless or negligent handling resulting in accidental damage of a product. Barrel obstructions due to ammunition or improper maintenance. Ordinary wear and tear of a product including cosmetic damage. Unauthorized repairs not made by SWS Rifles LLC. Damage caused by not conducting routine maintenance resulting in rust or corrosion. Damage cause by hand-loads or by ammunition defects.
The use of the following types of ammunition will void the warranty: Corrosive military surplus, hand-loaded, factory re-manufactured, or factory loaded ammunition not loaded to C.I.P. or SAAMI specifications.
Any repairs that are conducted on a voided warranty will be at the expense of the customer. In order for warranty work to be conducted a RMA number must be on the product being repaired either on the shipping label or written on the package. If there is no RMA number present on the shipping label or written on the package, then the product will be returned to the courier used. Repair requests will be made through the Customer Service Department and at the time an RMA number will be issued. If the item was purchased directly from SWS Rifles LLC please have your order number and e-mail ready before contacting a Customer Service Representative.
If a product was not ordered from SWS Rifles LLC please provide an invoice from the dealer from which the product was purchased from and send the invoice to Customer Service through e-mail. When sending products for repair the contents of the package must be adequately secure to protect from damage that may occur during the shipping process. SWS Rifles LLC is not responsible for damage of a product caused by shipping.
If no issues are found with a warranty issue customer will be responsible for shipping to and from SWS Rifles. Payment for return shipping will be collected before product is shipped back to customer.
Lead Times
Please contact SWS Rifles LLC for estimated lead times. Average build times are estimated at 6+ months.
Cancellations
Order cancellations by the customer for any build prior to transfer will result in the forfeiture of his or her initial deposit (50% of the build price plus fees). Custom upgrades (e.g., custom paint, barrel upgrades, and non-standard parts) are non-refundable.
Pick up Time Frame for Form 4s and 3s
Form 4— Once the ATF has approved the transfer and the rifle is finished, customers will have 30 days to pick up the order. After 30 days a $40 a month storage fee will be assessed from the day the order is complete and the transfer has been approved. After 180 days the rifle will be placed on our inventory page for sale to the public. The customer will forfeit the initial deposit (50% of the build price plus fees). Custom upgrades (e.g., custom paint, barrel upgrades, and non-standard parts) are non-refundable. (Late fees and forfeiture of the rifle do not apply to deployed active military.)
Form 3—Once the item is ready to ship and the Form 3 has been approved the customer will have 30 days to pay the remaining balance. After 30 days a $40 a month storage fee will be assessed from the day the order is complete and the transfer has been approved. After 180 days the rifle will be placed on our inventory page for sale to the public. The customer will forfeit the initial initial deposit (50% of the build price plus fees). Custom upgrades (e.g., custom paint, barrel upgrades, and non-standard parts) are non-refundable. (Late fees and forfeiture of the rifle do not apply to deployed active military.)
Form 4 Denial
If you (the customer) are denied a Form 4 transfer OR the Form 4 is Returned Without Action, you (the customer) forfeit all claims to your rifle, barrel, and/or pistol as well as your initial deposit (50% of the build price plus $200 per tax stamp). Custom upgrades (e.g., custom paint, barrel upgrades, and non-standard parts) are non-refundable. The terms “rifle” and “pistol” refer to all components necessary for reasonable functionality of the firearm. Receivers and/or actions supplied by customers who are denied a Form 4 transfer are no longer eligible to own a firearm and his or her action and/or receiver cannot be returned. If a customer provides a receiver and/or action and the Form 4 is Returned Without Action, a customer must pass a new background check in order for his or her action/receiver to be returned.
Government Intervention / Legislation
What happens if the government passes legislation banning or restricting ownership of NFA item? First and foremost, SWS Rifles LLC will comply with all City/State/Federal rulings and laws. Customer rifles will be delivered with non-suppressed barrels in the event that suppressors are restricted. If AR style weapons are banned or restricted, SWS Rifles LLC will deliver as much of the build/rifle that is legally possible. No refunds will be given.
Limitation of Liability
SWS Rifles LLC shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if SWS Rifles LLC has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Notice
SWS Rifles LLC may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to SWS Rifles LLC.
Indemnification
You agree to indemnify, defend, and hold harmless SWS Rifles LLC, its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.
Third-Party Links
In an attempt to provide increased value to our visitors, SWS Rifles LLC may link to sites operated by third parties. However, even if the third party is affiliated with SWS Rifles LLC, SWS Rifles LLC has no control over these linked sites, all of which have separate privacy and data collection practices, independent of SWS Rifles LLC. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, SWS Rifles LLC seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).
